It is a common practice for people leaving the UAE for good to leave powers of attorney in respect of the sale of their vehicles to their close relatives or friends. Given the market conditions, it may not be always possible for them to sell the vehicle in a timely manner before they depart from the UAE. We receive regular request from our clients in order for us to prepare vehicle powers of attorney to ensure that the owner of the vehicle provides necessary powers to the relevant friend or a family member in order for them to sell the vehicle and transfer the money to the owner at a later stage. This post intends to clarify the process for preparing the power of attorney for the sale of the vehicle and the relevant cost.
Prepare the power of attorney in Arabic
The first step is for us to prepare the power of attorney and the draft of the power of attorney in English and have it approved by the owner of the vehicle. Once the draft in English has been approved by the owner, it is then translated into Arabic language through the legal translators certified by the UAE Ministry of Justice. We then provide three original of the printed vehicle power of attorney to the owner for the next step which is the notarization.
Signing of the power of attorney at the Notary Public
The next step is for the owner of the power of attorney to visit the Notary Public and sign the power of attorney in the presence of the Notary Public. The Notary Public would register one of the original of the power of attorney in the records of the court and return two originals of the power of attorney to you.
Payment of the Notary Public fee
The Notary Public fee for the registration of the vehicle power of attorney is AED 267. Once this fee is paid the process of the registration of the power of attorney at the Notary Public is completed.
Once the above steps have been completed, you can leave one original of the power of attorney with your attorney/agent for him/her to use it at the time of the sale of the vehicle. It is also important to note that your attorney/agent will be able to drive the vehicle based on the powers granted in the power of attorney. The attorney/agent should be able to complete the process of the sale and the cancellation of the salik card relying upon the power of attorney at the relevant time. As agreed between you and your attorney/agent, your attorney/agent can then transfer the sale to your account.
