Terms and Conditions

  • E-Notarized POA shall be issued in Arabic only by email from the Court. Should you require it in English and in Arabic format, a bilingual e-notarization fee of AED 199 shall apply.
 

Powers Included in a General POA

The following powers can be assigned by a general power of attorney:

  • Purchase shares in companies.
  • Form and run affairs of a company.
  • Represent before third parties, government departments and banks etc.
  • Represent before Etisalat, du, DEWA and other utility service providers.
  • Represent in legal affairs and appoint lawyers.
  • Sign contracts and other documents.
 

Power to Buy and Sell Assets

Selling of assets and real estate using a general power of attorney in the UAE depends on the regulations of each Emirate.

Emirate of Dubai, Sharjah, Ras Al Khaimah, Fujairah, Ajman and Umm Al Quwain

In principle, selling of assets and real estate are permitted in a general power of attorney as long as the person assigning the power (principal) and the person to whom the power is assigned (agent) share the following relationships:

  1. Husband and Wife
  2. Father and child
  3. Mother and child
  4. Siblings

For all other relationships, a special power of attorney is required to be signed for the sale of assets in these Emirates.

Emirate of Abu Dhabi

In Abu Dhabi, a general power of attorney cannot be used to assign any powers to sell any assets. A special power of attorney in Abu Dhabi is required to authorise someone to sell any assets including real estate property, vehicles or shares in companies.

Signing Process

Signing process depends on the whether the general POA is signed in the UAE or outside of the UAE.

Option 1: Sign in UAE to use General POA in UAE

If you are present in the UAE, a general power of attorney can be signed before a notary public in Dubai, Abu Dhabi, Sharjah, Ras Al Khaimah, Fujairah, Ajman or Um Al Quwain. Once notarized, the power of attorney is validly accepted in the whole UAE.

Online Notarization in Dubai

In Dubai, a general POA can also be notarized via the BOTIM app. The following steps can be taken for online notarization:

  • Sending an email to the Dubai notary public with the following details:
  • Mobile number of the principal that is subscribed to the BOTIM app.
  • Copy of the power of attorney.
  • Valid IDs.
  • Notary public holds a video call via BOTIM app for verification of identities, and thereupon approves the POA.
  • The approved and stamped POA can be collected by the agent residing in Dubai/UAE from the office of the Dubai notary public.

Online Notarization in Abu Dhabi

A power of attorney can also be notarized online with the Abu Dhabi Judicial Department (ADJD). The process for online notarization is as follows:

  • A duly translated (English and Arabic) copy of the general POA is uploaded along with the identification cards of the principal, agent and the translator. On the portal of the ADJD, the payment can be made on the payment link gateway of ADJD.
  • ADJD will verify the identities of the principal and the agent by organizing a video call.
  • The digitally signed final copy of the general POA is emailed to the principal / agent.

Option 2: Sign outside UAE to use in UAE

If you are outside the UAE and are unable to use online notarization, you can sign a general POA before a notary public in your country of residence. The POA will be valid for use in the UAE once legalisation process is completed at the following departments:

Government departments in the country of residence

  • Ministry of Foreign Affairs
  • UAE Embassy

Government departments in UAE

  • Ministry of Foreign Affairs
  • Ministry of Justice after Arabic translation
 

Sign in UAE to Use General POA Outside UAE

If you reside in the UAE and wish to use the POA outside of UAE, a general power of attorney can be signed before a notary public in the UAE. Depending upon the country where the power of attorney will be used, the POA will be attested by the following departments:

  • The Ministry of Foreign Affairs in the UAE.
  • Embassy/consulate of the country where the power of attorney will be used.

General Power of Attorney for India

If the power of attorney is intended to be signed in the UAE and used in India, then the POA will be signed before the offices of IVS Global. This type of POA is not required to be translated into Arabic.
